CONTEST TERMS AND CONDITIONS: 2020 HALLOWEEN – 2020 Halloween Photo CONTEST (the “Contest”) NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING. SUBJECT TO THE RESTICTIONS BELOW, PARTICIPANTS DO NOT NEED TO BE GLENWOOD TELEPHONE COMPANY CUSTOMERS. CONTEST RULES: A. Eligibility: This Contest is offered and open to residents of the following Counties: Georgia (“Eligible Counties(s)”)(“Contestant(s)”). Contestants must be a legal US resident 18 years of age or older at time of entry. By participating in the Contest, Contestants consent to use of their child(ren)’s image in connection with the Contest and specifically, use by Glenwood Telephone Company (“GTC”) of photos submitted for display and promotional purposes (including, but not limited to GTC social media platforms) without reservation of any rights. The Contest is subject to all applicable federal, state and local laws and regulations. Void where prohibited. B. How to Enter: Contestants may enter by visiting the following URL: https://www2.gtconline.com/2020-halloween-photo-contest/ .2020 Halloween Photo Contest Entry Form Participants are solely responsible for any data or wireless charges used to enter the Contest. No purchase necessary. No entry fee required. This is a one-time contest, with judging and winners selected only once at the end of the Contest. Limit one photo entry per person. C. How to Win: Winners will be chosen by a committee of GTC employees at the end of the Contest. This committee of GTC employees will judge the entries using its own methods and aesthetic discretion. Winners will be selected from Contestants who enter the Contest and are residents of an Eligible County(s). All-new Fire HD 8 Kids Edition tablet, 8" HD display, 32 GB, Blue Kid-Proof Case will be awarded at the end of the Contest to one (1) Contest winner. Photograph/Picture must be submitted via the GTC Kids Costume Photo Entry Form in a digital format which can be shared on GTC social media platforms. Drawings will occur within five (5) days of the end of the Entry Period (defined below). GTC will contact winners via phone and email Contest winners will be required to confirm they are a legal US resident, 18 years of age or older, and show a valid ID, and must provide a U.S. mailing address to deliver the prize. Winners must respond to GTC within five (5) days of receipt of the notification or their entry will be forfeited. GTC reserves the right to choose a new winner after the sixth (6th) day using the same methods mentioned above. In the event there are no qualifying entries, no winner will be selected. Contestant’s first and last initial, and state of entry and winning photograph/picture will be used on GTC social media platforms (Ex: John D. from Georgia!). Receipt by winner of the prize offered in the Contest is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT GTC'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION. D. What You Win: GTC will select one Contestant as a winner at the end of the Entry period to win an All-new Fire HD 8 Kids Edition tablet, 8" HD display, 32 GB, Blue Kid-Proof Case or other equivalent prize. The estimated retail value of each prize is up to $79.99. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. Acceptance of prize constitutes permission for GTC to use winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law. E. Your Odds: The odds of winning depend on the number of eligible entries received. F. Entry Period: Entry Period: October 16, 2020 thru November 2, 2020. Judging to be conducted on November 3rd, 2020, through November 5th, 2020, winner to be announced on November 6th, 2020. A. Original Content; Ownership By participating in this Contest, each Contestant certifies they are the exclusive owner of the copyright and all other proprietary rights in any and all photos submitted by the Contestant. Contestants further certify that they have the right to grant to any third party the right to use, reproduce, distribute, perform and display any photo or text. All entries must have appropriate clearances, permissions and releases PRIOR to uploading, or may be eliminated from the Contest. B. Rights Granted by Contest Participants: By entering this Contest and submitting your photos, Contestant understands and agrees that GTC and/or any third party acting on behalf of GTC has the right, where permitted by law, to use the content and personal information for any promotional purposes without limitation and without any further compensation, notice, review, or consent. C. Social Media: Entrants should understand that they are providing their information to GTC. This Contest is in no way sponsored, endorsed or administered by, or associated by any third party (including social media companies). General Terms: 1. Agreement to Rules: By participating, you agree to be unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of GTC as final and binding as it relates to the content. 2. General Contest Terms: GTC reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Contest or change these terms. Should (in GTC’s sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Contest, GTC may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by GTC. GTC reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or violates these Terms & Conditions. 3. Limitation of Liability: By entering, you agree to release and hold harmless GTC and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; (v) electronic or human error which may occur in the administration of the Contest or the processing of entries. 4. Disputes: THIS CONTEST IS GOVERNED BY THE LAWS OF THE UNITED STATES, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, Contestants agree that any and all disputes which cannot be resolved between the parties and causes of action arising out of, or connected with, this Contest shall be resolved individually, without resort to any form of class action, exclusively before a court located in Georgia having jurisdiction. Further, in any such dispute, under no circumstances will Contestants be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than Contestants’ actual out-of-pocket expenses (i.e. costs associated with entering this Contest), and Contestants further waive all rights to have damages multiplied or increased. 5. We take your privacy very seriously and agree not to share any of your information with any third party, other than as may be necessary to administer this Contest. 6. Results will be available on or about November 6, 2020. All requests must be received by November 2, 2020.
